THE PERSON THAT IS THE OFFICIAL “ARE YOU THE CENTRE MALL’S $10,000 FUGITIVE?” WILL NOT ASK YOU TO LEAVE THE LOCATION IN WHICH YOU IDENTIFY HIM/HER. DO NOT FOLLOW OR ACCEPT A RIDE FROM ANYONE IDENTIFYING THEMSELVES AS THE FUGITIVE.

THE PERSON THAT IS THE OFFICIAL “ARE YOU THE CENTRE MALL’S $10,000 FUGITIVE?” WILL PROVIDE IDENTIFICATION AND GIVE YOU A SPECIAL LETTER ON OFFICIAL MORGUARD INVESTMENTS LIMITED LETTERHEAD PAPER SIGNED BY A MEMBER OF SENIOR STAFF AS WELL AS A PHONE NUMBER TO CALL AND A PASSWORD TO VERIFY THAT THE FUGITIVE HAS BEEN FOUND.
1. How to Enter the Contest:
a. The “Are you The Centre Mall’s $10,000 Fugitive?” contest (the “Contest”) is subject to the rules (the “Contest Rules”) set out herein.
b. The sponsors (the “Sponsors”) of the Contest are Centre at Circle & Eighth Property Inc. (“The Centre Mall”) and Rawlco Radio Ltd. (“Rawlco Radio”).
c. The Contest will begin on April 15, 2008 at approximately 8:15 a.m. Central Time (“CST”) and, subject to these Contest Rules, end when the person that is The Centre Mall’s $10,000 Fugitive (the “Fugitive”) has been found and identified and the winner (the “Winner”) of the Contest has been declared in accordance with these Contest Rules.
d. To participate in the Contest, listen to C95 to hear the clues as to the identity and/or location of the Fugitive. One clue will be broadcast on C95 each business day (i.e., Monday to Friday (other than statutory or public holidays in the Province of Saskatchewan)) at approximately 8:15 a.m. In each week of the Contest, additional clues (the “Additional Clues”) will be given. The Additional Clues given in a week will be given on random business days during that week. The Additional Clues will be broadcast on The Centre Mall website (www.thecentremall.com) and sent by e-mail to C95 VIPs. To find out how to become a C95 VIP, visit the C95 website (www.C95.com). New clues will not be broadcast on the weekend, only previously announced clues.
e. The Fugitive will be an individual either residing or working in the City of Saskatoon during the Contest period. C95 listeners will be encouraged to listen to C95 for clues as to the identity and/or location of the Fugitive.
f. The Winner (as determined in accordance with and subject to these Rules) will be entitled to a Prize (more particularly described in paragraph 3 a. herein) in the amount of $10,000. In order to claim the Prize, the listener will be required to approach the Fugitive in person and ask the following question (the “Winning Question”) word-for-word or verbatim:
“ARE YOU THE CENTRE MALL’S $10,000 FUGITIVE?”
g. If the person asked IS the Fugitive, he or she will give the prospective winner (the “Prospective Winner”) a letter, a card or other document (the “Official Letter”) on official Morguard Investments Ltd. letterhead or stationary (an original, not a photocopy) signed by senior staff of Morguard Investments Ltd. The Official Letter will also contain a phone number and a password. The Prospective Winner will be instructed to call the number during regular business hours and reveal the secret password contained in the Official Letter to verify initial authenticity.
h. The Winning Question must be asked directly, in person and in close physical proximity to the person whom the listener believes to be the Fugitive. If the person asked IS the Fugitive and he or she has been asked the Winning Question in the exact, proper way as outlined above, the Fugitive will answer in the affirmative and will proceed to present the Prospective Winner with the Official Letter as outlined above. IF THE FUGITIVE IS ASKED AN INCORRECT QUESTION OR IS APPROACHED IN A MANNER THAT IS IN VIOLATION OF THESE CONTEST RULES, HE OR SHE WILL DENY THAT HE OR SHE IS THE FUGITIVE.
i. In the event that more than one person approaches the Fugitive with a question, the listener who first correctly asks the Winning Question will be determined to be the Prospective Winner, pending compliance with all other Contest Rules as determined by the Sponsors, after which determination the Prospective Winner will be declared the Winner by the Sponsors. If more than one person correctly asks the Winning Question at the same time, the Prize will be divided evenly among all qualified and verified contestants following the verification process.
j. Clues as to the identity and/or location of the Fugitive may or may not be repeated and may or may not be posted at The Centre Mall (www.thecentremall.com) or C95 website (www.C95.com). Bonus clues may be broadcast at any time at the sole discretion of the Sponsors. In addition, people visiting The Centre Mall website and members of the C95 VIP Club may receive bonus clues via e-mail. There is no cost to view The Centre Mall website (www.thecentremall.com) or join the C95 VIP Club, which may be accessed via the C95 website (www.C95.com).
k. Participants in this Contest agree to abide by these Contest Rules and further agree that decisions regarding interpretation of the Rules, and determination and verification of the Winner are within the absolute discretion of the Sponsors and that all decisions are final.
l. The Fugitive must be approached in accordance with these Contest Rules. Violation of the Contest Rules will immediately disqualify a participant from the Contest. In addition to the rules contained in section 1 h. above, the following also apply:
1) The Fugitive may not be approached by telephone
2) The Fugitive may not be approached when traveling in private transport
3) The Fugitive may not be approached in a private residence or place of accommodation
4) The Fugitive may not be asked the Winning Question over a public address system, broadcast equipment or any other form of mass communication.
5) The Fugitive may be approached in public places between the hours of 7 a.m. and 8 p.m. Monday-Sunday. Approaching the Fugitive outside these time parameters will cause the Fugitive to respond to the Winning Question in the negative, even if all other Contest Rules have been followed.
m. There is one person who has been designated The Centre Mall’s $10,000 Fugitive. The Sponsors at their absolute discretion may designate another person to replace the original individual in the role of the Fugitive. If the Sponsors decide to designate another person as the Fugitive, clues will be amended as needed so as not to mislead listeners as to the identity or location of the Fugitive.
n. The Sponsors do not guarantee the safety of participants in this Contest. By participating, contestants agree that The Centre Mall, Morguard Investments Limited in its personal capacity or as agent for Morguard REIT, Morguard REIT, Rawlco Radio, tenants of The Centre Mall, and the officers, directors and employees of any of the foregoing will have no liability whatsoever in the event of injuries, losses or damages of any kind in connection with or arising out of connection to the participation in this Contest, they are not responsible for the negligence of any contestant who causes bodily harm or property damage in connection with this Contest, and they are not responsible for the negligence of any contestant.
o. The Sponsors will conduct this Contest in accordance with all laws and hereby emphasizes that listeners will NOT be asked to break any law or city/town ordinance in order to play or win this Contest. Participants are responsible for acting in accordance with all laws of the Province of Saskatchewan and the laws of Canada applicable therein. Further, if it is determined that any law has been violated in order to win this Contest, that person will be disqualified at the discretion of the Sponsors.
p. Harassment of any individual during this Contest will be grounds for disqualification at the discretion of the Sponsors.
q. Anyone who answers the Winning Question in the affirmative and does not present the Official Letter as outlined above is NOT the Fugitive. The Sponsors are not responsible for imposters and will not award any participant the Prize following interaction with an imposter.
r. The Fugitive will be reasonably easy to access and approach. He or she must be approached in a public place or place where the general public has reasonable access. Contestants found to be trespassing on private property will be immediately disqualified. No risk taking will be necessary to find the Fugitive.
2. Eligibility Restrictions:
a. The Contest is open to all C95 listeners 18 or older who legally reside within the Province of Saskatchewan. The Centre Mall’s employees and tenants (and their employees), Morguard Investments Limited, Morguard REIT, Rawlco Radio, its licensee, their affiliated entities, advertising agencies, participating sponsors/promotional partners, other media stations in the Saskatoon, Saskatchewan listening area and the members of their immediate families are ineligible to participate or win.
3. The Prize:
a. The Winner of the Contest is entitled to a prize (the “Prize”) in the amount of $10,000.00 to be paid by cheque within sixty (60) days of verification of the winner by the Sponsors.
b. There will be only one prize, namely the one (1) $10,000 prize, awarded in this Contest. There are no other prizes that will be awarded in this Contest.
c. The Prize must be picked up at the office of The Centre Mall 3510 8th Street East, Saskatoon, SK, S7H 0W6.
d. If the Prize is not picked up by the Winner within (60) sixty days of the Winner being notified that he or she has won the Prize, the Winner forfeits the Prize.
e. The Prize may not be transferred by the Winner to another person.
4. Selection of Winner:
a. Decisions of the Sponsors with respect to the Contest and the Winner are final.
b. A Prospective Winner will be declared the Winner after it has been determined by the Sponsors that the Prospective Winner is the Winner in accordance with these Contest Rules.
c. If the Winner cannot accept the Prize or a Prospective Winner is determined to be ineligible by the Sponsors for any reason to receive the Prize, the Sponsors reserve the right to either end the Contest or send the Fugitive out into the community to be found again by someone else. The Sponsors also reserve the right to select an alternate person to be the winner if the Winner is either unable to accept the Prize or a Prospective Winner is determined to be ineligible to receive the Prize for any reason.
d. The Prospective Winner agrees to cooperate with the Sponsors in the conduct of any investigation deemed necessary or appropriate to determine the legitimacy of the contestant’s fair play. This may include interviews, submission to one or more polygraph tests and full disclosure of the relationship the Prospective Winner may have with the person identified as the Fugitive.
e. If it is discovered that the Fugitive has engaged in any conduct contrary to the Contest Rules, the Sponsors will declare the Contest over without awarding the Prize and may or may not continue the Contest with an alternate Fugitive as determined by the Sponsors.
5. Conditions:
a. Payments of all federal and provincial taxes in connection with the Prize are solely the responsibility of the Winner.
b. By participating in the Contest, the Winner or Winners (if paragraph 1 i. above is applicable) (and their guest or traveling companion, if any) agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and to sign a publicity release prior to acceptance of the Prize.
c. Prior to awarding any prizes, the Sponsors in their sole discretion may require the Winner or Winners (if paragraph 1 i. above is applicable) to sign a liability release agreeing to hold and save The Centre Mall, and its tenants, Morguard Investments Limited in its personal capacity and as agent for Morguard REIT, Morguard REIT, Rawlco Radio, its licensee, their affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the Prize or participation in the Contest.
d. The Sponsors reserve the right to make changes in the Contest Rules, including the substitution of a prize or prizes of equivalent or greater value for the Prize, which will become effective upon announcement.
e. Failure to comply with the Contest Rules may result in a contestant's disqualification, at the sole discretion of the Sponsors.
f. The Sponsors are not responsible for typographical or other errors in the printing, the offering or the administration of the Contest or in the announcement of a prize.
